1. Definitions

In these Terms and Conditions:

  • "Company," "We," "Us," "Our" refers to Rivamaris, located at 12/8 Moo 4, Ao Nang, Krabi 81180, Thailand
  • "Services" refers to yacht charter experiences and related offerings provided by Rivamaris
  • "Guest," "You," "Your" refers to the individual or entity booking or using our Services
  • "Charter" refers to the yacht rental and associated services for a specified period
  • "Vessel" refers to the yacht or boat used for the Charter
  • "Agreement" refers to these Terms and Conditions plus any booking confirmation

2. Acceptance of Terms

By making a booking inquiry, confirming a reservation, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our Services.

You must be at least 18 years of age to book our Services. By making a booking, you represent that you have the legal capacity to enter into this Agreement.

3. Service Description

3.1 Charter Services

We provide yacht charter experiences in Krabi's coastal waters, including morning cruises, full-day explorations, and multi-night retreats. Each service includes vessel rental, professional crew, specified meals, and described equipment as outlined in the service description.

3.2 Service Availability

Services are subject to availability and weather conditions. We operate primarily during favorable weather seasons and reserve the right to modify or cancel services based on safety considerations.

3.3 Service Modifications

While we strive to provide services as described, itineraries may be modified based on weather, sea conditions, or other circumstances beyond our control. The Captain has final authority over all navigation and safety decisions.

4. Booking and Payment

4.1 Booking Process

Bookings are confirmed upon receipt of required deposit and signed booking agreement. All bookings are subject to availability and confirmation from Rivamaris.

4.2 Payment Terms

  • A deposit of 50% of the total charter fee is required to secure a booking
  • The remaining 50% balance is due 14 days before the charter departure date
  • Payments are accepted in Thai Baht (THB) via bank transfer or agreed payment methods
  • All prices are inclusive of specified services, meals, and equipment as described

4.3 Price Currency

All prices are quoted in Thai Baht (THB). Exchange rate fluctuations are the responsibility of the Guest.

5. Cancellations and Refunds

5.1 Guest Cancellations

  • Cancellations 30+ days before departure: Full refund minus 10% administrative fee
  • Cancellations 15-29 days before departure: 50% refund of total charter fee
  • Cancellations 7-14 days before departure: 25% refund of total charter fee
  • Cancellations less than 7 days before departure: No refund

5.2 Weather Cancellations

If weather conditions prevent safe departure as determined by the Captain, Guests will receive a full refund or the option to reschedule without penalty. Weather decisions are made by the Captain and are final.

5.3 Company Cancellations

We reserve the right to cancel charters due to circumstances beyond our control. In such cases, you will receive a full refund or rescheduling option.

6. Guest Responsibilities

6.1 Safety Compliance

Guests must:

  • Follow all safety instructions provided by crew members
  • Wear life jackets when required
  • Not interfere with vessel operation or navigation
  • Inform crew of any medical conditions or concerns
  • Remain in designated safe areas during vessel movement

6.2 Conduct

Guests agree to:

  • Treat crew, other guests, and property with respect
  • Not engage in behavior that endangers safety or disturbs others
  • Not bring illegal substances or prohibited items aboard
  • Follow environmental guidelines and marine park regulations

6.3 Health Requirements

Guests must disclose any medical conditions, allergies, or dietary requirements at the time of booking. We recommend travel insurance covering medical emergencies.

7. Limitation of Liability

7.1 Service Provision

Services are provided "as is" with reasonable care and skill. We do not guarantee specific results, weather conditions, or wildlife sightings.

7.2 Liability Cap

Our liability for any claim arising from the Services is limited to the amount paid for the Charter, except in cases of death or personal injury caused by our negligence.

7.3 Excluded Liabilities

We are not liable for:

  • Loss or damage to personal property
  • Injuries or illness not caused by our negligence
  • Delays or cancellations due to weather or circumstances beyond our control
  • Consequential or indirect losses

8. Insurance

We maintain appropriate marine liability insurance and vessel insurance. Guests are strongly encouraged to obtain personal travel insurance covering medical expenses, trip cancellation, and personal property.

9. Intellectual Property

All content on our website, including text, images, logos, and design, is owned by Rivamaris or our licensors. You may not reproduce, distribute, or use this content without our written permission. You grant us permission to use photographs or videos taken during charters for marketing purposes unless you explicitly opt out in writing.

10. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: severe weather, natural disasters, government actions, labor disputes, or other force majeure events.

11. Indemnification

You agree to indemnify and hold harmless Rivamaris, its officers, crew, and agents from any claims, damages, or expenses arising from your violation of these Terms or your conduct during the Charter.

12. Dispute Resolution

12.1 Informal Resolution

12.2 Governing Law

These Terms are governed by the laws of Thailand. Any disputes shall be subject to the exclusive jurisdiction of the courts of Krabi Province, Thailand.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting to our website. Your continued use of our Services after changes indicates acceptance of the modified Terms. Bookings made before changes take effect are governed by the Terms in place at the time of booking.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with your booking confirmation, constitute the entire agreement between you and Rivamaris regarding the Services and supersede any prior agreements or understandings.
